CONTRACT, WAIVER, RELEASE AND INDEMNIFICATION

I understand that I will be engaging in potentially-risky activities with the South Carolina Wildlife Federation and Consulting for Nature, LLC, and in consideration for the services offered, I hereby agree to the terms of this WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK.  The terms “SCWF” and “The Company” as used herein are defined to include the South Carolina Wildlife Federation & Consulting for Nature, LLC, their agents, employees, members, officers, partners, insurers, assigns, and affiliates. This Waiver, Release of Liability, and Assumption of Risk is intended to apply to and to relinquish any such rights that I may have against SCWF and the Company as defined above.

I recognize that there are certain inherent risks associated with the activities I will engage in. I recognize that those risks specifically include physical injury and death. I hereby assume full responsibility and waive rights for any personal injury, death, or property damage occurring in connection with my association with SCWF or the Company.  Activities associated with SCWF and the Company posing risks to me may include but are not limited to travel to and from the activities, travel during the activities, insect bites, snake bites, encounters with other wild animals, traversing dangerous landscapes, drowning, encountering dangerous weather, and encountering hazardous plants such as poison ivy and poison oak. This list is illustrative and not exhaustive of the risks that I am assuming.

I hereby waive all rights and release any and all claims, causes of action, liability, and rights that I may have against SCWF or the Company as a result of my participation in any activities associated with, sponsored by, or carried out by SCWF or the Company, their agents, employees, members, officers, partners, assigns, or affiliates.  I waive such rights and release such claims, causes of action, rights, and liability even if the acts or omissions giving rise to such claims, causes of action, and rights, arise from or otherwise are the negligent, reckless, or willful acts or omissions of SCWF or the Company as defined above.  I hereby waive all such rights and release all such claims, causes of action, and rights even though acts and omissions giving rise to them may have occurred before or may occur after my participation in the activities.

I understand that I am giving up my rights to hold liable SCWF or the Company and all of their agents, members, officers, owners, employees, and assigns liable for any injuries or damages which I may suffer or sustain while participating in the activities. Knowing this, and in consideration of the right to participate in these activities, I hereby voluntarily release SCWF & the Company from any liability resulting from my participation in activities offered by SCWF or the Company. This release is intended to encompass acts and omissions of others as described above.  I understand and agree that this release applies to personal injury, property damage, or wrongful death, which I may suffer, even if caused by the acts or omissions, including negligence, of others, including SCWF or the Company.

I understand and agree that this release will have the effect of releasing, discharging, waiving, and forever relinquishing, to the fullest extent permitted by law, any and all claims or causes of action that I may have or have had, whether past, present, or future, whether known or unknown, and whether anticipated or unanticipated by me, arising out of my participation in the activities with SCWF or the Company.  This release constitutes a complete release, discharge, and waiver of any and all actions or causes of action against SCWF or the Company related to these activities.

I understand and agree that by signing this release, I am assuming full responsibility for any and all risk of death or personal injury or property damage suffered by me while participating in the activities referenced above. I understand and agree that this release will be binding on me, my spouse (if any), my heirs, my personal representatives, my assigns, my children and guardian ad litem for said children.

I hereby give permission for transportation to any medical facility or hospital and I authorize for any qualified guide or medical personnel to render necessary emergency medical care for myself.

I authorize and release to the SCWF the use of my image in any photograph or video recording for any purpose of the SCWF and waive payment or any future profits that might result from such.

I HAVE READ THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT FULLY AND UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

CANCELLATION POLICY:
Notice of cancellation must be made in writing to SCWF office (electronic or hard copy). Refunds must be specifically requested, or registration fees will be counted as a donation to SCWF. Refunds will be issued by check, and mailed on the 15th and 30th of every month. 

• 90% of registration fees will be refunded if notice is received more than 30 days before event.
• 75% of fees will be refunded if notice is received 7-29 days before event.
• 50% of fees will be refunded if notice is received 0-7 days before event.

SCWF reserves the right to cancel any event, due to unforeseen circumstances, extreme weather or low registration. Any cancellation by SCWF will result in a full refund for all registrants, or transfer of registration fees to another event if space is available.
